Terms and Conditions

1. Booking & Payments
A non-refundable booking fee of 50% of the total fee is required to secure your date.

All expenses and production costs must be paid in advance of the shoot unless otherwise agreed in writing and such invoices are due on presentation.

All other invoices must be paid within 30 days of the date of issue. The Photographer reserves the right to charge interest on late payments at the rate prescribed by the Late Payment of Commercial Debts (Interest) Act 1998 from the date payment was due until the date payment is made.

If there is a delay of one month or more between agreed pre-production work and the shoot, the Photographer reserves the right to invoice the Client for the pre-production element of the Fee and for any expenses already incurred by the Photographer.

Usage License and any third party fees negotiated by the Photographer are payable regardless of whether Licensed Images are in fact used by the Client or the Advertiser.

All payments are due in pounds sterling unless expressly stated otherwise.

2. Usage & Licensing
Unless otherwise specified, the Photographer retains the copyright to all images.

  • The Client is granted a non-exclusive, non-transferable license to use the delivered images for personal use (e.g. social media).

  • Commercial use and promotional use (e.g., album covers, merchandise, advertisements) requires a separate licensing agreement. This also occurs for image use in general outside the company’s (band) usage

  • No use may be made before payment in full without the Photographer’s express agreement in writing.

  • Usage of the Licensed Images is limited to use of such images as provided by the Photographer and the Client shall not manipulate any Licensed Photograph or make use of only part of any individual image without the prior written permission of the Photographer.

  • Neither the Client nor the Advertiser may use the Licensed Images in relation to any additional products or services not specified in the Usage License.

3. Image Delivery
Images are delivered in high-resolution JPEG format. RAW files are not provided unless agreed upon in writing. The Photographer is not responsible for print quality if printed outside a recommended lab.

4. Cancellation & Rescheduling
If the Client cancels within 7 days of the scheduled shoot, 50% of the total fee is still payable. Rescheduling due to illness, travel delays, or unforeseen circumstances is permitted once without penalty if communicated in a timely manner.

Cancelation less than 7 days of the scheduled shoot will require 100% of the total fee to be payable.

5. Client Responsibilities
The Client must ensure proper access to the venue, appropriate passes or credentials, and safe working conditions. The Photographer is not liable for missed shots due to restricted access or non-cooperative behavior from artists or staff.

6. Liability
While every reasonable effort will be made, the Photographer is not liable for acts of God, equipment failure, or conditions beyond control that may prevent the successful delivery of services.

7. Image Retention
Edited images are stored for 2 years after delivery. Unedited images may be deleted after the shoot. Backup storage is not guaranteed unless separately arranged.

8. Credits

The Photographer reserves the right to a credit during use of any images or media used unless specified in the licence to use form.

9. Agreement
By booking services with the Photographer, the Client agrees to these Terms and Conditions. Any amendments must be agreed upon in writing.
